Resolution 2022-46 Intent to Convey Easement to City of Lodi_ADA.pdf
Summary: The District is the owner of the real property located at West Vine Street in Lodi (the “Property”). The City of Lodi (“City”), has requested that the District grant an easement in over, under and across the Property for public roadway purposes and to construct, maintain, repair, replace, remove and operate lines for public utilities, both publicly and privately owned, together with the right to enter upon the Property to the extent that such entry may be necessary for the constructing, maintaining, repairing, replacing, removing and operating said access, lines or appurtenances thereto (the “Right-of-Way and Public Utility Easement”).

Pursuant to Education Code section 17556, et seq., a school district, by two-thirds (2/3) vote of its Governing Board, may convey land for a public right-of-way and/or to dedicate an easement to a public corporation, or private corporation engaged in the public utility business, to lay, construct, reconstruct, maintain, and operate electric or telephone lines and access roads used in connection therewith, either with or without consideration and without a vote of the electors of the District first being taken, by engaging in a multi-step statutory process.

The first step of this process will occur at this meeting. In accordance with Education Code section 17559, the public hearing is held as an opportunity for the public to comment on the proposed conveyance of the Easement. After the noticed public hearing, set for July 13, 2021, and assuming there is no related protest from the public, the Board may proceed to adopt a resolution authorizing the conveyance and consummation of the Right-of-Way and Public Utility Easement to City at the same meeting or at a meeting held within sixty (60) days thereafter.
Funding: There is no financial impact associated with the approval of this resolution.
Recommendation: It is recommended the Board of Education adopt Resolution 2021-46.
